Svitlana Kheda

 

Svitlana Kheda, counsel, is heading Sayenko Kharenko’s labour and compliance practice, in particular leading the firm’s labour/employment, privacy/data protection and anti-corruption and mediation practice groups. Dr Kheda is the internationally recognized expert in all of the above areas of law.

Dr Kheda has over 20 years of experience in advising leading international companies on a wide range of sophisticated, complex issues in the field of labour/employment, privacy/data protection and anti-corruption/anti-bribery legislation. Svitlana Kheda also has extensive international experience in public-private partnership in infrastructure.

In particular, Svitlana Kheda focuses on adjusting labour policies and procedures of the multinational groups to Ukrainian legislation, including adapting of corporate policies of foreign companies, developed according to the US Foreign Corrupt Practices Act (FCPA) and the UK Bribery Act 2010 (UKBA), to Ukrainian anticorruption legislation, and developing standard anti-corruption contract clauses and other corporate documentation in the anti-corruption area. Dr Kheda is experienced in conducting the FCPA and the UKBA compliance due-diligence reviews of the Ukrainian targets. Svitlana Kheda regularly prepares legal opinions on various instances of gift/charity/grant-in-aid giving and providing hospitality to the government officials and other subjects of liability for corrupt offenses.

Dr Kheda is a certified mediator with over 10 years of experience in successful use of mediation and quasi-mediation procedures for settlement of labour disputes and conflicts, including those connected with compliance violations.

Prior to joining Sayenko Kharenko, Svitlana Kheda headed the Programs Department of the International Law Institute (Washington, DC, U.S.A.), where, in particular, she developed and taught the training seminars “Anti-Corruption Regulation”, “Arbitration and Mediation”, “Public-Private Partnership in Infrastructure”, and “Legislative Drafting” for senior governmental officials and members of parliaments of developing countries and emerging economies. Dr Kheda’s professional experience also includes working for a leading western law firm operating in Ukraine, where she was in charge of the labour and employment practice for eight years, and supervising (at the client’s request) for over a year the HR department of one of Ukraine’s biggest garment factories.

  • drafted amendments to the Law of Ukraine “On Personal Data Protection” and has been actively involved in the policy shaping in this area;
  • chaired the parliamentary working group on developing the Ukrainian public-private partnership legislation;
  • member of the governmental working group tasked with developing Ukrainian public-private partnership legislation;
  • drafted amendments to the Law of Ukraine “On Private-Public Partnership” and subordinate legislation;
  • drafted and promoted the Mediation bill adopted by the parliament in the first reading; and
  • champions development of public-private partnership and mediation in Ukraine according to the international standards.
