Sayenko Kharenko advised on the EUR 138 mln financing for the construction of the second stage of the wind farm by Ukraine’s largest energy company
Sayenko Kharenko provided legal advice on Ukrainian law issues to Landesbank Berlin AG (“Landesbank Berlin”) on the EUR 138 million financing for the construction of the second stage of the Botievo wind farm by “Wind Power” LLC (“Wind Power”), the “green energy” segment of DTEK, Ukraine’s largest energy company.
The loan has a tenure of 10 years and will be used for the purchase and installation of 35 wind energy turbines of the farm, the construction of which is expected to be finished in 2014.
In 2012, Sayenko Kharenko acted as legal counsel to Landesbank Berlin on the EUR 107 million financing for the construction of the first stage of the Botievo wind farm. The deal was considered one of the largest long-term investments in private business within the energy sector and was recognized as “Deal of the Year-2012” according to Trade Finance Magazine and Global Trade Review Magazine.
Landesbank Berlin is one of the largest commercial banks in Germany and a holding company of the following banks: Berliner Sparkasse and Landesbank Berlin.
Wind Power is a subsidiary of DTEK, the largest privately owned, vertically integrated energy company in Ukraine. DTEK’s portfolio of wind-energy projects amounts to around 1,200 MW, which is unprecedented for not only the company but also the Ukrainian energy sector overall.
Sayenko Kharenko team involved in the transaction included senior associate Igor Lozenko, associates Marta Hontaruk and Taras Shyb and was led by partner Nazar Chernyavsky.
